Any lawyers on here? For companies requiring only a small percentage of people back in the office, could there be an inequitable or discrimination lawsuit here?

Look at who’s in the office in STL compared to Bloomfield. I can see the strategy and why they’d want STL leaders to quit. They close the site, run away with what they think is the knowledge, and have complete control. This was Cordani’s greedy plan. It’s just a shame the company was not as smart as Anthem to see it in the beginning.

@ian+1syV5zbF They will not be eliminating all H1B employees, just a lot of them. That is one of the many unethical ways they follow the letter but not the spirit of the law. Not unlike how the company has laid off thousands over the past year, but done it in targeted waves in different orgs and locations to avoid having to give notice due to WARN laws. A journalist needs to do an investigative article on how many people have h actually been laid off and make it public knowledge out there. Cigna thinks they are being sneaky but they aren’t smart enough to realize how smart most of their employees actually are.

You have a better chance jumping ship to Cigna Medicare now before the divesture. Most Cigna Medicare Employees will remain or become remote after the sale to HCSC.
It's not a guarantee, but you increase your odds at staying/becoming remote.

For there to be a lawsuit for FOW and office guidelines they would have to single out a total group of people. For example only employees over age 40 or only women or only men. That or if they were all protected classes that were required into the office. OR if it could be proved that it was solely retaliatory and as punishment for something other than performance or attendance.

Can we trust the information that suggests they will terminate all H1B employees? I recall coming across a similar post previously. The issue lies with the managers who hire H1Bs despite their job responsibilities not aligning with the requirements of a specialty occupation.
Regardless considering lodging a complaint with the labor department about the H1B hiring practices at Cigna.

I think this would only become an issue for the company if there becomes a point where it is blatantly obvious that they selected certain people to go into the office with the intention that they quit. Nothing has been enforced yet so there really isn’t anything especially with how the handbook is written.

My spouse is an attorney in the field. No lawyer would take this case (without getting paid a massive retainer up front) because there’s no law around how companies can decide where their employees work. If an individual or group, who are ADA or FMLA protected that are being forced into the office without reasonable accommodation for their disabilities that would be a winnable lawsuit.

@tsi+1syV5zbF May be moot because Cigna is about to lay off most of its H1B employees. They won’t have to pay sponsorship top of the line, and will be hiring directly in India in the new Hyderabad “Innovation” Hub. Aka offshore farm.

We are also interested in determining whether there is a possibility of pursuing legal action for favoring H1Bs over citizens in various areas. It appears that Cigna may be submitting H1B applications to USCIS with false information. They are employing H1Bs for managerial positions without any unique qualifications required for the role. If they are successfully obtaining H1Bs, it suggests that they are supplying inaccurate information to USCIS and the Department of Labor.
