"An H-1B visa holder generally has a 60-day grace period after their employment ends to find a new job and file a new H-1B petition, or to depart the U.S. During this grace period, the individual maintains their nonimmigrant status, but they cannot work unless a new H-1B petition is filed and approved. If a new petition isn't filed and approved within the 60 days, or if the existing visa validity expires sooner, the H-1B holder must leave the U.S. to avoid accruing unlawful presence"
