Thread regarding Capital One layoffs

Can someone explain how Capital One is able to deny unemployment if they place someone on a PIP?

I just want clarification on how this works.

@dhjq+1oRdsZIn this is simply not true. If a company fires you because of some performance metrics, you’re still eligible for unemployment benefits. Don’t buy into the corporate propaganda and appeal if C1 disputes.

Because they consider it a performance related firing. Companies don’t have to provide unemployment if they fire you due to performance. It su-ks, but that’s how they are able to do it.

It is possible you may receive a severance. They will let you know if you are eligible.

Not true. I was on a PIP there, and I still got a severance, as well as U/e benefits. PIP means performance improvement plan.vit stays in their records. You should still qualify for u/e. Your just can't apply to Capital anymore for any roles. But hey. Wth wants to work there, again?

It's the compancestry that have to pay for unemployment benefits. When you apply the company can tell the unemployment office you were fired because of poor performance or misconduct and deny your claim. Therefore, if they fire you, still apply anyways, and if the company disputes it you accuse them of wrongful termination. Don't let it stop you. Apply.

Without knowing specifics, if there was anything that could have fallen under “conduct” issues (such as attendance issues, unprofessionalism, etc.) Capital One will fight the UE and make it seem as though it wasn’t the PIP. I was a Unit Manager for more than 10 years and I fortunately was forced to play that game. Sr. Managers (aka the PAs) and Department Managers know how to manipulate it. They would make us document the sh-t out of EVERYTHING so we could show that to AR. And then of course they would run the bus over the Manager and play d-mb. I got the fu-k out of the toxic cesspool that has become Capital One.

As long as they don’t have evidence of willful misconduct, you’ll be eligible for unemployment benefits. Performance improvement plans don’t imply willful misconduct.

PIP has 2 options:

  1. 2nd chance after Coaching Plan to try and improve on the bullsh** 'opportunities' your manager has made up about you to validate a below strong rating; or
  1. you opt out of the BS and choose to leave.

If you put up with option (1) and are terminated as a result of them saying you still haven't met the bar (which is typically the outcome as is their design), why wouldn't you be able to collect unemployment?

As long as you didn't break any rules, you should be able to get UE if you can't find employment. Is there something I'm missing?

If they have a paper trail, they can deny it. I would still attend the hearing. Capital One lays a lot of people off and often don't make the hearings.

I think a PIP means you were fired. Performance related, but you were fired. I do not think UE is possible if you were fired.
