@Cu - “(c) This Agreement does not apply to an employee employed on an employment contract with a Perth based position or position of Coordinator and above.”

Perth-based employees have their own contracts and were not part of that negotiation. It is no more discriminatory having different redundancy packages between those under this agreement and those based in Perth than those based in San Ramon and those based in Perth.

The old enhanced redundancy entitlement came from the WA Oil enterprise agreement. Use to be 4 weeks for each year of service capped at 2 years. Or something like that. Take a look at the current EBA for chevron abu lng ops folks which is public knowledge. https://www.fwc.gov.au/document-search/view/3/aHR0cHM6Ly9zYXNyY2RhdGFwcmRhdWVhYS5ibG9iLmNvcmUud2luZG93cy5uZXQvZW50ZXJwcmlzZWFncmVlbWVudHMvMjAyMy8xMS9hZTUyMjQxNi5wZGY1?sid=&q=Chevron. Be hard to do something very different to this as discriminatory

No severance package for US employees. Just 60 days notice as required by law.

@de, there’s a couple of ways of looking at it.

In the US, CVX has typically provided a package beyond the minimum legal requirement, so giving a package beyond the legal minimum requirement in other countries isn’t out of the question. That being said, there is no obligation to.

The other aspect is that CVX may choose to offer an enhance severance package in exchange for the employee accepting additional conditions that wouldn’t be enforceable without an extended package - for example, rehire clauses and NDAs. Without the enhance package, there would be no benefit to the employee to accept additional terms.

Severance packages are regulated by the government, not Chevron. The packages in countries like Australia, Canada, Netherlands etc etc are significantly more generous than the US package.

@af, why would there be legal problems if the ABU gives a lesser redundancy package than in the past, as long as it still meets the legal requirements? 4 weeks/year, cap of two years, is FAR beyond what the Australian government requires.

@at, not sure what the average will be, but I reckon some teams will be hit bigger than 20%. some teams might be 50%+

Are we still looking at 20% across the board?

Be a he-l of a legal challenge to change the terms from all the other past redundancies at the ABU
