"Come on SEC and FBI, we can't let these criminals get away with this."

If you have tangible, actionable _evidence_ that's not already in all the court filings and SEC reports, contact the FBI and SEC.

_Evidence_ of violating stuff involving state regulations: go to your PSC.

_Evidence_ of misuse of rural broadband subsidies: go to the FBI and the press (not sure the FCC is worth the bother these days).

Otherwise, at this point, what's been publicly documented looks like mostly greed, venality and mismanagement. Maybe criminal but enough gray areas to make prosecution a lot of work. DAs and the FBI are busy enough already.

The creditors probably have evidence but they want to maximize their recovery; blackmail doesn't work if they go public.

_New_ evidence is what will make things happen.

Little Rock 5 are the scum of the earth. Everything they say is untrue. You can't hide anymore, everyone now knows you for the lowlifes you are, you're nothing more than common crooks. Can't wait til you perjure yourself in your bogus court case with your brother (literally) in crime Uniti. Come on SEC and FBI, we can't let these criminals get away with this.

Don't the ratepayers end up paying for some of this?

Yes the ratepayers do end up paying. But this peep could have walked out with an entire switching office and it would not come close to what the LR execs stole as they bankrupted the company. And yes, you ratepayers will cover their million dollar bonuses as well.

Not going to feel bad for Windstream. Watched a close friend of mine and a top notch tech get escorted out like a criminal. Why? Because his company vehicle got broken into and they stole Windstream equipment. He called the police and got the police report. He was told he should have been making 10 trips from his vehicle into work everyday and storing all contents of his van in the CO......but that they wouldnt pay OT for that, so thats on your time

Got my issue yesterday. I worked nearly 8 years for them, learning Voice, Data, Transport & SD-WAN. Yep, that's right... I became the actual Super Tech their vision for the company wanted. What did I get for it? Well, re-read the 1st sentence.

It's only theft if WS prosecutes, seeing that they got no balls to go after him I will supplement my severance same way the peep did, two wrongs don't make it right but sure will make me feel better as I walk out the door :)

"Avery also said that this year's incentives were similar to the performance incentive program used by the company prior it filing for Chapter 11."

Great performance Arkansas 5, So in other words, expect losses of 30 to 40 million a month.

Judge approves incentive plan

Last week, U.S. Bankruptcy Judge Robert Drain approved Windstream’s 2020 executive incentive plan, according to a story by Channel Partners. According to Channel Partners, Windstream spokesman David Avery said the court had to approve Windstream's 2020 incentive plan due to its restructuring under Chapter 11. Avery also said that this year's incentives were similar to the performance incentive program used by the company prior it filing for Chapter 11.

The bonus plan approved by Judge Drain included:

• Tony Thomas, Windstream’s president and CEO, could receive up to $9.5 million.

• Robert Gunderman, chief financial officer and treasurer, up to nearly $3.5 million.

• Layne Levine, president of enterprise, up to nearly $2.3 million.

• Jeffery Small, president of Kinetic, more than $2.1 million.

• Kristi Moody, executive vice president-general counsel and corporate secretary, more than $1.4 million.

In February, Windstream lost a legal battle with New York hedge fund Aurelius Capital Management over whether Windstream had defaulted on bonds by spinning off the Uniti Group four years ago. As part of that spinoff, Windstream transferred copper-based network assets to Uniti, which Windstream leased back from Uniti to serve its 1.4 million residential and business customers across its 18-state footprint.

After the February ruling, Windstream filed for Chapter 11 reorganization in the U.S. Bankruptcy Court for the Southern District of New York that same month.

Windstream is paying $54 million per month to Uniti for access to Uniti's network assets. The master lease with Uniti is set to expire in 2030, and has an annual rent of approximately $659 million. Windstream filed a complaint against Uniti on July 25 that sought to re-characterize its relationship with Uniti from a lease to a financing arrangement.

In its November third quarter earnings report, Windstream Holding's revenues were down across the board. Little Rock, Ark.-based Windstream's adjusted total revenue and sales were $1.27 billion in the quarter, which was down from $1.38 billion in the same quarter a year ago. After earning $1.4 billion in the second quarter of 2018, Windstream posted $1.29 billion in total revenue and sales during its second quarter earnings report.

I worked for a company for 25yrs......then Windstream bought them. I lasted 6 months and then resigned. By far the worst company I have ever seen, the incompetence at the top was astounding.
