Thread regarding Bank of New York Mellon Corp. layoffs

Told to just stop coming in????

Last week higher mgmt called me and just straight up told me to stop coming in. Told me I’ll receive my notice in writing in the new year and I’ll receive a few months of pay. Benefits will last until EOY. Ummmmmmm is this normal??? Where’s the formality? I can’t even tell if i was fired or let go or punk’d. Can someone please advise on what I should do? Going to file for unemployment now I guess……..

No they dont.
It’s lost income that is recovered. Not punitive damages. And these are settlements. Punitive damages are financial penalties awarded by a court to punish a defendant for particularly harmful behavior and to deter similar conduct in the future. BNY will only go by lost income or a claim of proof to it. BNY will also not admit damages or wrongdoing to settle. When you contract an attorney to recover damages, you incur the cost not BNY in a settlement. If BNY owed you 52 weeks salary of say $150,000, they arent going to cough up another 50 grand to make it all better for you.
That’s why it truly su-ks having to make them do right by you… and you also pay tax on all this too. Including what you pay your attorney.

@ce what about 6 yr tenure, does this impact severance provided? I was let go today and told not to return to work and that is be paid throughout December. I really dont feel 60 days is sufficient, is it time for me to get a lawyer?

@h7 the attorney will recoup all your severance in addition bny will be required to pay your attorney fees and more for a punitive award.

@OP sorry this happened to you. Same happened to me. Engage an attorney immediately if you have a lot of years there. If not, just move on. What they did to you is not abnormal for them or necessarily consistent with what they might do to someone else. It’s a bloodbath in there however you look at it. For those still working there, I sincerely wish you all the best. They can’t get rid of everyone but they are going to go after about 25% of company in some form. Very bad situation.

If it’s not in writing it didn’t happen. That being said you should send whoever called you an email referencing everything (s)he told you and see what response you get if any. Until then carry on normally.

Very not normal even for our einsatzgruppen here at BNY. You need something in writing saying you are getting paid and when your release is at the least. My advice to you- Get an employment and labor attorney immediately and have them be your contact.

@c2 managers were told to communicate before 12/8, also mgmt had the choice to separate right away with pay or have them work through December. In January they will receive paperwork for additional pay and benefits for 60 days. There has been management meeting all week.

@bw nothing in writing. they told me i'd get something in writing in the new year. and oh i'm 'carrying on'.... more like shutting down my laptop, moving forward and never looking back ever again lol

No normal because if you were marked below expectations for goals those mgmt meetings with hr are happening and we have to wait to get oracle communication before delivering anything

Unfortunately this is the direction this company is taking for anyone that was a did not meets for year end. From what i understand you should have benefits end pay until March. The term used is you were separated from the company.
