Thread regarding ViacomCBS layoffs

Explain this to me

Let’s say that you are a Phase 2 employee who gets blindsided jn November and laid off. Do you get severence as well? Or just nothing, but the ability to collect unemployment.

Seems kind of unfair to not allow an early option to quit and take the severence pay because you are remote. You would hope they would not lay off any remote workers in November but from what I understand everyone in the entire company is vulnerable on November 11.

@cg that isn’t true for commissions where they can just flat out cancel that during employment. What is extremely odd, is that sales VPs rely HEAVILY on their support staff and two to three levels below them are eligible for commissions which can make up to 25%-40% of yearly compensation…however if you are below VP, you don’t receive a pro-rated commission if you opt-out…not only is that gross, but where does all that commission money that was EARNED by support staff go?!

@ch okay well they must be an outlier then because it literally says in the expanded terms that VPs and above would qualify for pro-rated bonus... sounds like something they should bring up with a labor lawyer for their specific case

@cg Not true. I know a VP in phase 1 who got offered 2 weeks for every year of service for the opt-in. That was it.

@c0 only VPs and above are getting prorated bonus for phase 1. Not sure about layoffs or phase 2 but in theory they don’t have to give anyone their bonus… they could completely get rid of bonuses.

HR confirmed for our group as well as others that the severance package (2 weeks per year for most of us) will be the same regardless if you are phase 1, 2 or part of Nov layoff.

my friend was remote /- she got 90 days severance i know there's a lawsuit but she did get three months severance paid out like regular pay

are we back to november 11 date after earnings report ? bc i thought it was now 10/28 - so that layoff and buy outs numbers could all be reported

@ap Warn act covers when at a particular worksite the number / percentage of layoff covered a limit . Then they need to provide 60/90 days based on state .
For remote workers the worksite marked is Telecommuter and so wont covered in WARN act .
Same happened in previous rounds .

@OP Everyone will get severance regardless of RTO opt-in to severance, or laid off. Being remote or not won't affect this. We/re all considered employees, and covered under the same rules and regulations. As far as difference in RTO opt-in vs layoff severance package, I dont' know. I tend to believe they're comparable though.

@ad Everyone is covered under the WARN act, what are you talking about? Remote workers are not second class citizens.

I don't think anyone knows whether the severance terms in November will be the same as the ones offered to the voluntary resigners, but 'leadership' has to be aware that they will generate a ton of terrible press and employee uproar if they offer a worse deal for the people they can.

Regardless of what the terms are, though, rest assured that they'll give some kind of package for all full-time staff members, based on years of service, whether it's a period of continuing payouts or a lump sum.
