exactly. you can’t pay bills with a WARN notice… you can with severance/pay/whatever.

@db Sort of, but not quite. More, there is a financial penalty for not filing a WARN, that financial penalty is essentially paying the worker for 2 months as a recompense. Since Nike is already paying the penalty upfront, there are no grounds for an employee to complain.

While it does seem kind of shady, at the end of the day, it accomplishes what the WARN Act was meant to solve, and it benefits the worker more than a simple notice.

There are specific laws about what triggers a WARN notice. If Nike doesn't meet those triggers, the company doesn't have to file.

There's never a warn notice, but every time people come on here asking where it is. It's the same answer as usual, they give a few months severance so they don't have to post the notice til later.
