The EEOC stands as a safeguard against workplace discrimination. If you’ve been unfairly dismissed or treated differently because of the presence of H-1B workers in your team, you have every right to file a charge with them. No worker should be sidelined or mistreated.

U.S. Department of Labor (DOL)

The DOL ensures that U.S. workers are protected against any unfair treatment. Employers are legally obligated to prioritize American workers for hiring and retention. If you’ve been bypassed for an H-1B worker or unfairly dismissed, the DOL will investigate violations and hold employers accountable.

State Fair Employment Practices Agencies (FEPAs)

Many states have their own agencies to fight workplace discrimination and unfair dismissal. These agencies are there to ensure that U.S. workers’ rights are respected. Check your state’s official website to find out how you can take action.

National Labor Relations Board (NLRB)

Contact Your Elected Officials

U.S. Citizenship and Immigration Services (USCIS)

It is illegal for employers to displace U.S. workers in favor of H-1B workers or to keep H-1B workers on staff while laying off U.S. employees. If you have evidence of this, you can report these violations to USCIS for thorough investigation and enforcement.

U.S. Immigration and Customs Enforcement (ICE)

The presence of H-1B workers from countries that are adversarial to U.S. national security can expose companies and industries to significant risks—from intellectual property theft to potential espionage. If you suspect that there’s foreign influence or other national security threats in your workplace, it’s important to report this to ICE’s Homeland Security Investigations (HSI).

Federal Bureau of Investigation (FBI)

@1q8 having h1b as manager will only lead to nepotism. Example is Fedex it's ceo is Indian and out of the blue replaced the vice president of IT to an Indian with no skills.

Lowe's is nother example a company that supports veterans has its hq in india and hires a bunch of h1bs in the states .

Ll of this is only going to cause for sensitive information leaking out due too h1bs selling personal info of Americans.

A lot of companies are still hiring h1bs f1s opts and useless h4eads

This guy has been posting same stuff across the sites of all the financial firms. I have worked in this industry for 25+ years and personally I haven’t come across any situations when H1Bs or other visa holders were given preference over the US Citizens. Teams generally hire the best candidates out of the pool of candidates that their hiring/talent team provides. It’s true that for some specific types of roles, we get more applicants that are H1B holders but not interviewing them outright would be discriminatory

I am officially addicted to this bac layoffs site. I am an indian born us citizen who left bank of america few years ago. I bought into the layoff gospel and waited several years thinking I would be laid off. It didnt happen. I wasn't getting promoted either, so left bac for greener pasture. Looking back, Bank of America wasn't bad at all, would I go back? may be, may be not depending on the compensation. Team mates ? they were always the best hands down, white, brown or colored you pick.

@b5 Some good news came out today from the Trump administration. For green card processing, H1Bs have to go to their country of origin.

No employer will be ready to have their foreign employees be outside the US for extended period of time.

@a4 At the time of this post, 8 down votes indicating source coming from non-US citizens. In America, there should not be any management with H-1B visas having hiring authority. PERIOD. Somewhere in U.S. banking laws, there should also have language regarding foreign nationals having access to U.S. customer financial data. With SPAM calls, text, and emails, I always wonder where the criminals get their information.

@OP Same music for over 25 years, just different circumstances. You can complain all you want but the precedence has been set with government agencies inundated by cases after cases to combat the problem. Congress from BOTH parties need to address this problem together to save U.S. citizens. Unfortunately, with BOTH parties benefitting from insider trading to inflate their financial portfolio, I do not envision H-1B visas going away as support will always go to corporate. Now, ask yourself how much senior management donate to PAC. BofA contributions (2024) - 40.00% to Democrats, 59.49% to Republicans.
