Layoff on Maternity Leave

Did anyone else get laid off while on maternity leave? Do you know how it’s impacted?

HR was no help in getting clarity before I lost access to my email, etc. on Tuesday. I’ve only been on leave for 3 weeks, so not sure if there are legal obligations for Target to fulfill my full approved leave or if it can just end.

Curious if others in a similar situation have heard more on it.

They will pay you until January, that is your maternity leave pay.

@b8 They might give her more leave, but not out of any legal obligation. If they do it would be out of a sense of fear of a lawsuit for fear the layoff was because of the maternity.

Even that's unlikely. This is a mass layoff, and it's unlikely that the people making the decisions even knew who's on leave. So the most likely scenario is they say "take the severance package and sign the release, or leave it".

Take it from someone that's hired lawyers and gone through the court system. Lawyers are RARELY worth it, and lawsuits very much less worth it. Avoid both at all costs.

Talk to an employment lawyer. I imagine Target will give you more to cover the leave but good grounds to negotiate. Don’t sign the separation agreement right away until you vet it with a lawyer.

I'd highly doubt it. They're under legal obligations to give you leave while you're employed, but since you aren't anymore, they don't have to provide the full 12 weeks. Unless you have something in your specific employment contact, I'd say you're in the same boat as everyone else.
