They do pay a prorated bonus if you retire or are let go due to restructuring. However, if you quit or get let go for performance, no bonus for you.
I mean, that’s pretty low, why even put it in the documents if they’re not going to pay? And for retirees, that’s just shameful.
I don't really think anything involving you not getting a bonus can be considered wage theft. Only if they didn't pay you your base salary. You aren't actually entitled to bonuses. Are you owed any bonus? Absolutely not.

@a7 I believe you. They just overwrote this with the instructions during comp planning. If you see a strong case I would work with an attorney. You will be stronger in numbers if you have many people with the same story of being rendered ineligible.
I see clearly in the separation document a note that you are eligible for bonus for the period worked
Here is what it says in the bonus calculation document I was sent by a former colleague: “ Leaving the Company: No bonus is paid for voluntary quits, discharges, or releases before the payment date.”
