The Wage and Hour Division is responsible for enforcing some of the nation’s most comprehensive federal labor laws. This is protected and has nothing to do with your Servance package. Online filing is easy and can be anonymous as well. Would like to see how many people did it.

@a6 Interesting. So this only applies to physical locations and they can layoff remote employees endlessly with 0 notice? I’m learning a lot.

@bc This isn’t necessarily true. I worked for a company that was sued by employees and lost over this. They had to go back and pay each employee . That was in TX.

The Federal Government does not Investigate Warn Act violations. This is just legislation passed that has no backbone and is for politicians to shout they stand for the worker when campaigning. It's a ruse. Just google it

@a6 That is precisely why the “Wage and Hour Division” of the Federal government need to be made aware (anonymously by many, if need be) of how these corporations have expensive lawyers assisting them on how to thread (skirt) the finer points of the WARN Notice laws so that they can “legally” avoid WARN notices in most instances.

Maybe the Feds will change the laws to make it more difficult for them to “legally” avoid.

I've had people laid off in my department every year since 2000. They were all remote and therefore not part of a WARN notification. I'm not sure what this post is asking for, as Optum does file WARN notices when enough employees at a single location trigger the requirement. In most cases (at least with quarterly RIFs), those thresholds are not met.

Optum is not skipping WARNs, they just design most RIFs so WARNs are not triggered.

I am curious to know as well as to how many people did the inline filing. I hope many (thousands) persons did.

It is the only way things are going to change is if collectively we make use of every tool we can to battle against and seek to put a stop as to what all of the American corporations are doing in shedding all their American citizen workforce for cheap foreign labor and AI.

Yes, the system and tools are flawed as to protecting American workers. But the different tools, and there are many different types, are all we have. If you do nothing they win. And think of the next generation, like your kids, as well as the generation of workers, you grandchildren, after them.
