Thread regarding Target Corp. layoffs

Has anyone been asked to sign away rights to get severance?

Newer people to the corporate world might not know this, but often times a company will ask you to sign a document to get any sort of severance that releases the company from any liability, blah blah blah. Has anyone laid off been asked to do this?

If so, it likely makes sense to at least run it through an LLM first, and post it here. Knowledge is power, and sharing it with others can only help everyone.

These things often force employees to agree to non-disparagement, maybe even a non-compete, or other legal waivers of things like suing the company for (for example) age discrimination.

@a5 You give up your right to pursue any legal action as well as can't say anything bad about them. They also in writing say that they did no wrong and you are agreeing to that.

@dz Can you, yes. If they find out you received one you will have to pay back the duration of benefits you received that was = to your weeks of severance,

@dz Not any week you've received more in severance than the unemployment insurance payment would be, but after severance ends you get it.

Generally you're going to make more at a job of course. Don't let any employer tell you you can't apply for unemployment. It's the State that tells you if you qualify, not the employer, and the employer can't bar you from applying.

@cp That does seem reasonable. Age discrimination is nearly impossible to prove anyway.

@a5 At a summary level, the Agreement expected that I:
• Not recruit nor identify for recruitment by others for two years
• It’s unclear to me whether I could be a vendor to Target
• Return all Target property
• Re-employment within 45 of accepting the Agreement results in forfeiture of severance. OK to re-apply without consequence after 90 days of separation.
• Cooperate with Target in prosecution/defense of matters you have knowledge of
• Waive right to sue/seek damages from (they list who)
• Waive right to sue/seek damages from Age Discrimination
• Protect/not disclose all non-public information you’re aware of - such as past, current, future strategy, financials, proposals and agreements, etc.
IMO, this was all quite reasonable.

@OP When I got my Severance Agreement from Target a couple years ago, I read through it a couple times and read through a couple sections a couple more times, asked a couple questions to my HR rep, a single question to my nephew, a lawyer, and signed it. I came to see that 1) the document was reasonable; 2) the sooner I got the (substantial) money into my hands, the better, and I could move on; hardly any lawyer would touch it (risk/reward).
