PTO after being let go

I just got let go and I am in state that is not required to pay your PTO. I am told I can work until the end of July. I have 75 hours of PTO left, but told I cannot use any of it between now & the date I am gone. Is that legal? Shouldn’t I be able to use it?

DO NOT LET THEM SC--W YOU OUT OF PTO! I don't care what state you're in, FIGHT BACK! If they do mess with you and the amount of PTO falls within a small claims case - file a small claims lawsuit! Or consult with a lawyer who will take your case and only charge you if you win - there are more than you think out there. Make your case as much of a pain in the a-s as you can. You have nothing to lose!

I would include HR in this, reach out to the person who sent you your RIF packet. Ask if you are not allowed to use the PTO you have, what compensation are they going to give you? 75 additional hours of SUB pay? Extend your end day by 75 hours so you can take it? Ask the questions, and see what happens. You've already lost your job, so push back.

It should be illegal to steal people's earned time off but only some states have laws that protect employees from this predatory behavior of large corporations. It's BS.

Legally, they can't prevent you from taking PTO. I know because that happened to me. I was given one month's notice, and I immediately informed them that I would be going on PTO. I was told that I had to train the person who would be taking on my responsibilities. I said I would if they wanted to push back my last day. My manager said that wasn't possible, so I said, well, that's your problem then. They don't want a lawsuit, as the cost of a lawyer is more than what they are going to pay you.

First off - stand up for yourself!

Send an email, I will be using (tell don't ask) my PTO on XX days.

Before your last day, then when PTO is gone, you can call in sick or leave early with a headache. What are they going to do fire you?

Do zero work when you are working until your last moment.

Exit with the same compassion they showed your position - NONE

For the poor person who cannot use their PTO prior - that is so nasty -I know for a fact Directors have allowed others to use all their PTO then "work" the last few days

I would be sick ALOT - its the stress - your GI is a mess along with headaches, call EAP so there is a trail of reaching out for support. I forsee your sickness happening mid day on Thursdays and back on Tuesday - then Wed to Monday -

They can MAKE you be at work - but they cannot MAKE YOU WORK - you are sick doing your best.

I was RIFd today and they cut my access off immediately because of my “level” and the “sensitive nature” of my work. But my last day isn’t until July 25th. So I guess it’s just paid vacation.

It su-ks that you have to work for the next 30 days. I think it is cruel that they do this. Assuming they aren’t letting you take PTO so you can transition your work and knowledge transfer. I say they should’ve thought about that sooner. Trying to take PTO puts your sub pay at risk. So sh---y!

Leadership must be trying to change it up because people are disclosing riff dates. Did any of you have pto scheduled and they moved up the date because of it? Sorry you were riffed. I was riffed last year but got rehired.

@OP who told you that you couldn’t use it and did they understand you wanted to use it before your last day? I ask because I know they don’t want you to use PTO to extend your layoff date . This company works so hard to scr@w people over even while sending them out the door 😡
