Job was Eliminated, but no RIFF. Lower grade. Lower salary

I am hearing some folks are having their jobs eliminated but instead of giving them a RIFF document with severance rules, they are instead moving them to another department at a lower grade and salary.

My question is this legal to do without any written documenation and/or approval by the employee.

It is said that unless your salary drops below 20%, you do not get a package in this instance.

It seems to me that you have to at least sign some approval or acceptance of a transfer. Otherwise this is a quick way to restructure people at lower pay without the cost impact of a RIFF.

Please let me know if the above is a new tactic instead of RIFF.

Agree with checking your state DOL. In most cases if reduction of salary is within 10 percent the company is able to move staff without penalty.

Same thing here. Happened twice in a year. Never asked if I wanted to be in a different org. Never asked if I wanted a different job. Apparently we're supposed to be thankful that we weren't outright rifed. They do not set up valuable employees for success unless you're riding the coattails of a strong vp and up. Otherwise, this company doesn't give an actual ffffff about you or your career.

This just happened to me last week. Job was “eliminated“, then I was informed that I would be moving to a team that I had not traditionally worked on.

I didn’t experience a decrease in job grade, at least not verbally I haven’t seen anything in writing yet, and my salary will stay the same.

So I guess there’s sunshine in the middle of darkness. However, this is not a role that I want nor is it anywhere close to the role that I was in so I’m not certain what I’m going to do. Other than do the job that gives me, and look for a position more aligned to what I want at this point.

This happened to me 4 or so years ago. RIF in my department 6-8 people let go. Myself and one other were kept, however I was offered a 1 step lower E* position. I was given a couple of days to think about it. My choice was 1) Take the offer 2) Unemployment.
I took the offer and was ultimately moved to a different department where I let my new manager know what happened. We came up with a plan to get my original E* level back, we were successful but it took 2 years.

Check with your state DOL and see what they say. But, most likley you can be moved to another role and will have to take it our leave. My advice is to do a cr-ppy job and get fired. Depending on your state, you can get UE if your are fired for in ability to do the job.
