I just got terminated

I just got terminated for a supposedly hippa related violation and was totally blindsided by this with a ruse calling the one to one meeting my mid year review and then when logging into the meeting was greeted by my manager (so called)…

and a rep from HR!!…

just in time for me not to be able to log onto the early retirement account and accept the package from my email account that was sent to my work email only during last week when I was unable to access my work related to a personal disaster of a fire that displaced me from my home for the past 2 weeks as well as having my house destroyed at over 80% damage and will be months before the ball gets rolling with my insurance/demolition/construction to rebuild my house !!!!…

Humana doesn’t give a cr-p about their employees like they say they do…it’s all a ruse to use you until they don’t need you anymore!!!…

I was a faithful nurse and employee for almost 6 years as of my upcoming 08/12/2025 anniversary date with them!!!…Shame on them and shame on you the supervisor/so called manager of my team who has had it out for me since February of this year when I was voluntold to move to their team not by choice!!!…Run while you still can and accept the retirement package before they sn---h it out from under you like they have done me !!!!

@vc I get what you are saying but have you been on calls with offshore? What a joke! They get special provisions to have a room full of people chatting in the background during meetings? ridiculous!

@er HIPAA not HIPPA violations can include but not limited to seeing the screens. HUM says you need to be in a Room with the Door Closed. So dont waste your money on a lawyer. IMO.

@kf Yes, Humana's policy is wah is not to be used for childcare. Problem is, there is precedent of managers and above letting workers work while providing childcare. I can personally confirm it. A previous team I was on, the interviewee let us know in the interview her kids were home with her all day, in the same room. She was hired and told it will not be a problem. In essence Humana's policy is a moot point. It's only used for nefarious reasons as the poster demonstrated.

My opinion is that I don't see how the member overhearing a child's voice constitutes a violation of HIIPA.
A violation is generally that you use or cause to be used a unique health identifier; obtains individually identifiable health information relating to an individual; or discloses individually identifiable health information to another person
That doesn't seem to be the case at all.
Now depending on the wah policy, that may be a reason .

@kf just because her grandchild walked into her home office does not mean she/he was providing childcare while working. 4 year old would require constant supervision and working being on the phone as a nurse cannot provide that. It's obvious someone else in the home was watching the grandchild and grandchild happened to walk in the home office. That's what it sounds like to me

@kf I disagree. There are still MDs, VPs and c suite working at home. I know a certain high up VP and a regional med director whose kids are absolutely insane cussing screaming and fighting while they’re on calls. And they’re old enough to know better!

Ok here is the deal,work at home is not so you can provide childcare for your kids or grandchildren. I believe the work at home agreement even says that. They let this go during the pandemic but no more. You did commit a violation. You don’t have a legal leg to stand on.

@br yes the violation of HIPPA was in their minds that my manager via teams/five9 dialer phone system was listening to a live call unbeknownst to me at the time and then immediately scheduled a 1:1 while I was still on the phone with the member…& proceeded to tell me that I violated the Humana critical offense rule because my 4 year old grandson’s voice was heard briefly by her and my member…who wasn’t upset at all about the interruption which I apologized for…and my manager said it was a HIPPA violation because she heard him…crazy thing is that my grandson heard nothing healthcare related due to I was wrapping up the call and we wear headsets anyway ……nothing can be heard from the person’s end who is walking into the office at that point….ridiculous!!…I am in the process of retaining an attorney wish me luck;)

What did they say the violation was? Did they provide some proof? If so, was it viable. I ask because this is the 2nd post here, where someone was terminate under similar circumstances.

Very sorry to hear this. Some words of advice: Immediately file for unemployment. Humana most likely won't fight it and if they do, your state will hold a hearing and unless you did something particularly egregious, they’ll rule in your favor. Second step, retain an attorney that specializes in wrongful termination. If you’re over 50, disabled or another protected class, consider filing an EEOC complaint. Third step, file an appeal with HR. If you won this appeal or a wrongful termination suit, you’ll receive ample termination package. Final words- don’t give up!
