Thread regarding CDW layoffs

Anyone else laid off looking at their legal options?

My gut tells me I have no choice but to accept the severance they offered, but has anyone else challenged it in court or negotiated more?

I held firm and didn't hire an attorney but told them I would if they didn't provide me with more based on my record with the company. I wanted 12 weeks after they only gave me 2 and they gave me an extra 8 which I accepted. I felt it was a nice offer on their part to meet me more than half way there.

I contested the amount as well and settled for more than expected. We asked for more than what we wanted and were surprised with the agreement. I am in my mid 30s and a white male and did not have any performance issues. I received very good reviews every year. My attorney took the case for 12 percent of the increased winnings and nothing down.

@2hq With my package I bought a house with cash, went to Europe 3 times and I bought a bridge in Brooklyn It was very inexpensive!

My attorney took it for free and asked for 10 percent of the winnings which motivated him to go for more. They settled and we got all we asked for. I can’t give the specifics but I am taking my time to look into a new job and bought a house with cash and have visited Europe …twice.

Thanks Anonymous @100+1jtm1apbe for the information on challenging CDW's RIF package. It's nice that your dad is an employment attorney so there's no cost to you out of pocket to challenge the low-ball CDW package they offer you when they let you go. For those of us who plan to challenge CDW should we face the same fate would have to pay for an attorney. What would hiring an attorney cost us to challenge the package?

Would you mind sharing which sales division you were in? Did your manager get let go too since whatever reasons you were let go most likely reflects them as your leader?

I didn’t. I needed every penny. I was taking care of my mom and funding her cancer costs when I was laid off. I was forced to move into my inllaes home after cleaning out my savings to help her in her cancer fight. So now I have nothing and even if they had given me two more weeks, h would have appreciated it. I have tried to find another job but am struggling. I was one of the top three in sales every year and just can’t figure out what I did. Wrong to deserve all of this. I was a proud and loyal coworker who had never been attended off and had received recognition many times. I am still crushed and baffled.

Ditto. I can’t mention the specifics but same thing happened to me. You settled for more than I. I was given double after I said no and would pursue an attorney. Under 30.

Sorry for the late response. I don’t come on here a lot. I am the person that made the under 40 post and I was a CDW coworker. My father is an employment attorney and instructed me to challenge it because they will buckle to avoid court cost and what he called “tarnishing the brand” and they acted like they wouldn’t play in the sandbox and he said that was common before they would settle and it happened as he said. There is another coworker I told about this who is a CDW legacy, that did the same and received more. You just have to overcome the fear and stick to it. They are used to most just accepting but build their budget up to cover those that resist and want more.

You can take the severance and still file an age discrimination complaint with the EEOC. The severance does not violate your right to do that. You can also file with the Human Rights Commission in your state.

Laid off yesterday. Over 50. Came out of nowhere. The earnings call this morning was even more of a gut punch after all I did to help us succeed in Q1.

Yes, yes, yes. Won a great deal more before even making it to court but had to sign a non-disclosure letter about the winnings,, covered benefits, and specifics. All I will say is it was substantially more than I ever thought was possible at a younger age.

Yes I know of a couple who have challenged, and then they sign an NDA that’s enforceable for the settlement amount. They shut up and go away.
