As is well known, the Sears Holding Board is suing Eddie. The latest wrinkle is that the Sears Canada pensioners are suing Sears Holdings to the tune of $200M. There's a couple of ways to get standing here. The statute of limitations in NY state, where SDNY presides is six years. Just as importantly, the statute of limitations in Canada for fraudulent conveyances in Canada is ten years, and you can sue for recovery of land. So Sears Holdings can sue ESL and Seritage to get the land or equivalent value back, and then of course auctioned off in bankruptcy to satisfy Sears' many creditors. Which would be hilarious since everything here is owned by Eddie. This is what happens when you stiff your lawyers.
