Thread regarding Windstream Corp. layoffs

Gunderman Bros and conflict of interest -

How can these two brothers be allowed to be involved in any of the reorganization talks. Windstream must force UNITI to take a haircut if not a full scalping. How can Windstreamers have any faith that Bob will force Kenny to renegotiate - bottom line is you cannot.

Remember when the REIT venture was supposed to allow Windstream to grow larger from its existing 4 Billion Dollar Market Cap.

What happened to this plan?

What executives were responsible for this colossal mistake and failure? I bet those responsible last name starts with either a Gunderm or a Thom......

Worst Company and Leadership EVER.

I bet they will write a business case story on these fools incompetence, geed and lies

Uniti might also 'decide' to file Chapter 11. If one brother can do it, the other brother can do it just as well!

Not sure why you waste your time thinking about this. Nothing is going to change, they’ll keep all their money and we will all lose what we had.

I thought about that as soon as I learned of the case. It is a conflict of interest. I just want someone to be held accountable

Well, this cuts the other way, too. How can Uniti shareholders be sure Uniti won't cave?

Uniti holding high cards in this dispute from what I've read. Under bankruptcy rules, Windstream has a black/white choice to make: either "assume" (i.e., accept) the lease going forward as it's written -- or reject it in its entirety.

Legally, there's no requirement to renegotiate the lease unless both parties want to and I don't see why Uniti would want to.

That said, lots of weird things can happen in chapter 11. Certainly Windstream's creditors would be very eager to get better lease terms. The creditors have clout and good lawyers; maybe somebody will find some technicality to allow renegotiating.

As for the Gundermans, I won't say that they wouldn't try abuse their positions (I don't know them - they might be standup guys) but everybody is watching them. If they mess around, expect a ferocious lawsuit from either Windstream creditors or Uniti shareholders
