I spoke to an attorney last couple of weeks and ended up signing the agreement. He saidmost of the time scumbags like BNYM have a team of lawyers to protect themselves from this. However from my reading of the agreement, they can't prevent you from filing an EEOC complaint, just that, supposedly, you technically would forfeit any money awarded to you by EEOC.
I did an interesting thing in the past few days. I took the 'attachment C' sections and entered all the many hundreds of ages into a spreadsheet (god forbid they'd give us an electronic copy of it). I'm a fast typist and really was curious about this. At least in my division, the average age of the layoff group was 53, everything not laid off was an average of 47. I can't say I typed this up with absolute 100% accuracy, but let's say I did. Is that 6 year average difference significant for the purposes of EEOC?
