My earlier post on this was taken down, maybe I put in too much politics. They say my position was 'eliminated', but in the past few months, there were 2 people from iNautix that I know of in my division that accepted PERMANENT full time positions in NYC. This wasn't the usual situation where the came for a few weeks or months and returned, but permanently relocated. I'm sure this was NOT an isolated situation since I also kept hearing past few months that they felt for various reasons they wanted to reduce 'risk'. How can they say my position was 'eliminated' when in fact others coming from overseas effectively 'took' my and other's positions? Is there some sort of class action lawsuit possible - opinions?

I understand your situation. You need to take this up with the USCIS.

Layoff is also happened in Inautix- bnym tech division
And Inautix don’t have any on-site opportunities as such the case which you explain might be rare
Here in india many people have l1 visa but no on-site opportunity from company
Besides the company being able to make the case that those other employees were better qualified for the position and/or the spots they took weren’t your specific position, isn’t NY an at will employment state? Unfortunately, I doubt you have any sort of ground. But I’m just a random person on the internet. This question is best posed to a lawyer.
Not sure what standing you have in a class action lawsuit disputing a H1B visa since sponsoring you for the Visa is at the company's discretion.
There could be several reasons your position was eliminated. Most obvious is that in fact it might have been. Or maybe not so obvious is that in company opinion you're not good enough or making too much relative to your coworkers, or who knows. Will remain a mystery.
