Word is Dean Schwartz landed at Lowes

Christ, not only does he bring all of Sears' hardline relationships and Kenmore with him, he can pretty much let them know just what a disaster working Eddie is full monty. Lowes is really the true home of Craftsman now.

Where did you hear this.

I suspect that the timing of his resignation, minutes after Eddie missed the well publicized deadline to submit his bid after which Sears was supposed to have gone into liquidation is going to play into Schwartz's favor here, not to mention things like the fact that the agreement was made with SHLD, not Transform Holdco, and SHLD is intending to terminate employment of its employees regardless.

If Schwartz were at the top instead of Eddie, the hardline vendor relationships wouldn't have fallen into such a disastrous state. He had to repair them again and again thanks to Eddie's blatant lies.

I don't know about the guy in question, but this was actually a quite common practice at Sears at all levels, and continues to this day. It has been going on for years, along with a host of other things that might make you say, "yeah, right."

Working for P Dean Schwartz wasn't much of a picnic itself. He was a yes man for Eddie which is why he lasted longer than the others. He's appalling to subordinates and has the business sense of a turnip.

Any judge would laugh at the idea that Sears is a competor to Lowe’s. Now if he went to a flea market or Goodwill, maybe they’d have a case.

The loss of Perry was one of the few good things to come out of these last few months. Hopefully they replace him with someone who is both competent and knows how to treat subordinates.

I’m sure Lowes will be thrilled to have someone like him who feels it is his right to force his subordinates to work unpaid overtime to do his job so that he can go out and coach his daughters basketball team.

If true, I would recommend shorting Lowes stock immediately.

First off, Sears is incorporated in NYS, not IL, so wrong case law. Secondly, it does not matter if SHC was in BK, or if it looked like SHC was going to liquidate and terminate him or not. He left of his own volition and because of that the non-compete is still binding.

Now, I'm not licensed to practiced in Illinois, or whatever the controlling forum is wherever Schwarz's employment agreement controls, but Bankruptcy and non-competes are kind of interesting. Browsing through Illinois cases, since SHC was insolvent, if, at any point, Sears failed to pay even a single payment that was previously agreed upon, then Schwarz likely has close to an ironclad case that the terms of the non-compete were breached, which is pretty likely, since they were controlling all payments with an iron first throughout the bankruptcy, Schwarz's case looks tight to me.

.....he did. For 6-8 months IIRC. I’m calling BS until something more firm than “I heard” comes out. There was a ton of speculation that he left when he did to go ahead and start the clock on the non-compete vice waiting out the BK process.
