will the hardship fund be distributed only to new layoffs, or also to those already laid off ?

People are delusional if they think Eddie will set up a hardship fund

I don't think the article saying what this is about has been posted: https://www.reuters.com/article/us-sears-bankruptcy-severance/sears-workers-demand-hardship-fund-after-toys-r-us-success-idUSKCN1P228L

It has only been asked for, there isn't actually a fund yet and there is no guarantee there ever will be one, so nobody knows how it would work yet.

Good luck with that... Laid off workers can demand all they want, but it doesn't mean Sears /ESL is going to listen.

If it happens, regardless of the amount, it won't be enough to satisfy everyone

This is something that needs to be made clear in the initial demands. For example, set up the fund for all those let go after 12/31, or whatever date. Judges are not impressed by vagueness.

it would be tough to go back, because how far back do you go ? layoffs have been pretty constant for a long time now. I think that RUR will be successful, but only for layoffs going forward,

Eddie will find a way to weasel out and not pay, I wouldn’t worry about it
