@1eho File for the 20 weeks originally promised before bankruptcy. You might not get it, but you might as well ask for the maximum you were told.

To 1eho - my suggestion is to contact an attorney for advice. Of course Sears HR will not provide any assistance. They are swamped with all the layoffs the last few months and coached by upper management to not say anything that could be used against the company (not just Sears but other company's HR dept's as well)

My husband was promised 20 weeks severance before 10/15 if he worked thru 12/7. Two weeks ago he was shown a document that said 10 weeks. I don't believe either will happen. My question is should he file for the 20 weeks promised before or is that voided by the bk and should he file for the severance now or wait to see if it happens. This is so disheartening - there is really no way to get answers from corp or hr.

@1nca Yes, it's legal. Severance pay isn't a 'do or die' legal obligation like normal employee paychecks are, so it's just like the vendors who sold millions of dollars of merchandise to Sears before the bankruptcy that they didn't get paid for in time. Merch sold to Sears after the bankruptcy began is still getting paid-for, since otherwise nobody would sell them anything anymore, but sales beforehand mostly won't get paid. Some vendors/contractors even received a check that bounced, because Sears totally shut down their pre-bankruptcy corporate bank account and opened a new one, to make extra-sure they couldn't pay any more pre-bankruptcy bills.

How can they give severance to recently laid off employees at HE but cut off the severance to HE employees laid off prior to the bankruptcy filing. Is this legal ?

I am a shopper who does not work for Sears....but while entering the store one day, I picked up a candy wrapper left laying in the vestibule and tossed it in the trash.

Can I file for severance since I did housekeeping duties for Sears?

How much can I get?

I want compensation for my hard work that day....

I want my share of the pie.

I don't want Sears to screw me over on this!

Absolutely file with prime clerk, especially after reading in the news they want to pay bonuses to 18 top executives and 300 or so 'key employees'. That is what sparked me to file on prime clerk. This saga just keeps getting more ridiculous by the day.

That's the site. File for it especially if you were given final paperwork before BK filing. The ones promised severance after BK filing are likely to see something rather than nothing. At least try. Don't prove to the world that Sears beat you.
