Sears is not on the Oct 31 WARN notice that’s just published.

Warn act is not voided by chapter 11...

“a company cannot use bankruptcy to avoid giving proper layoff notices under WARN. If the employer knows, or should have reasonably known, that a layoff was foreseeable, it must give 60 days' written notice. Similarly, if the business continues to operate while in bankruptcy - for example, during a restructuring the company must adhere to WARN and provide notice 60 days before laying off workers. Likewise, if the business decides to cease operations and liquidate its assets, terminating its employees in the process, written notice to its employees is required. Thus, laid off employees are usually entitled to written WARN notice or pay in lieu of that notice, even if their employer is in bankruptcy.”

People leaving for new jobs and not being backfilled is reducing headcount just like a layoff would.

There will be no more cuts at HE. Staff has already been reduced to the bare minimum, and the remaining personnel are absolutely essential to ongoing and future operations.

Once under chapter 11 the Illinois warn act becomes irrelevant. Company does not need to provide severance in bankruptcy.

Warn act requires 60 days so there is some severance. And all these folks who talk about Thursday’s are fake. Layoffs are Tuesday and always have been.

they are in talks and meetings trying to figure out which departments to cut and which workers to force out or ask to retire.

Layoffs are coming starting this Thursday and next Thursday. No severance.

I would say nothing is going to be announced officially until after the court hearing on the 15th so probably by next Friday we'll know more about more about what stores are closing and where else they are going to cut.
