In addition to laying off most of the Portland claims office in September they also let go several very experienced claims counsel. Claims counsel were imbedded in primary departments and did most of the coverage determinations and risk transfer and were generally available to assist adjusters as needed. In addition to saving money on outside counsel they were the last line of defense against incorrect denials and other bad moves by adjusters. Expect a lot more DJs for breach of duty to defend and a collapse of primary casualty’s ability to properly handle risk transfer.
