H1Bs should not be allowed to apply for green card while working in USA. That's why they are all sticking around in USA for years and years for their green card processing especially if they are from India.

The system has flaws. I'm glad Trump is doing something about this cause it's going to be a tough year for engineers/IT folks of permanent resident in 2019 with so many IT companies laying off people or outsourcing the work to foreign companies. Just look at Verizon Communication layoff posts. They are moving ~2500 IT jobs to Infosys (Indian company).

The job posting may have been for a USA job but since it has been filled by H1B person now, it may have been taken down and the only job posting left for the similar position may be the European positions within the same department.

But I get your point that the job should have been offered to someone from USA within the same group as the H1B employee since there have been many layoffs in USA. Others from the same group would have been just as qualified as the H1B employee.

It amazes me how the H1Bs job gets saved even after being notified of layoffs for half of the group including the H1B employee but applies for a job (posted for Europe) and gets to work in a group in USA within that department which has a mix of Europe and USA employees.

Another words, to all those getting laid off, if the job is posted (no matter where the location) just apply and see if you get it. Seems like there are exceptions by HR and hire ups, so if you're lucky, you may just get the job in USA that's posted for Europe especially if the department has people working in all different countries.

Perhaps we need to remind the HR folks that H1B visa is a "Temporary" work visa. Once they have been notified they are going to be laid off, then they should be laid off and a USA employee being laid off should be the preference for jobs "within USA" (even if posted for another country). I wonder if any USA employee was given a chance to apply for the European job posting. Doesn't seem to be a fair practice in my opinion. I don't even understand how this was allowed to happen.

Austin might survive or be a forgotten footnote in the shuffle. Half the office is h1b anyways so I can imagine them shutting it down and shipping anyone who wants to keep h1b to Dallas.
