He loses control in a bankruptcy, the judge will decide who gets paid, how much and when. This is why he didn’t want to file, he can no longer control his fate then. I’m sure when the feds get a look at his books there are things in them that will get him into deeper trouble and he can’t hide it now. Couple that with how he can get hit with fraudulent conveyances when he defaults on any debt, he’s pretty much screwed.
