Thread regarding Hitachi Vantara layoffs

Laid off Hitachi Vantara employees may be eligible for additional compensation

Hitachi Vantara appears to be in violation of the California WARN notification. The layoffs from April (and other rounds) have yet to be reported:

Here are the penalties laid off employees in California are eligible for if there is a violation:

"A possible civil penalty of $500 a day for each day of violation. Employees may receive back pay to be paid at employee’s final rate or 3 year average rate of compensation, whichever is higher. In addition, employer is liable for cost of any medical expenses incurred by employees that would have been covered under an employee benefit plan. The employer is liable for period of violation up to 60 days or one-half the number of days the employee was employed whichever period is smaller. (California Labor Code Section 1403)"

Between sales, marketing, PM, PMM and the whole converged team, there was way over 50 impacted employees in California in April, 2018 (off payroll in June, 2018). I'd encourage all impacted employees to file a complaint.

calif rule is that if plant closure or mass layoff (50 or more ) employer at one time then they need to report . :)

I have been told that they werent required to because they didnt meet the rules that required it.

Wow I need to see about this but the layoff last April was indeed reported by EDD in 2017 so I am not sure if I qualify or not.
