State I'm in, after the payout of the severance , you can collect the unemployment .

Sears seems late on payout and unemployment is only 12 weeks .

That's what you are hanging around for.

Tulsa, OK., you can get both. The week I received my severance, I did not get my UI, vice vereser. I was let go on April 5, I filed the next day. No problem.

This is how it worked in Michigan when I was unemployed. The week I received my lump sum severance, I didn't get UI but the rest of the time I was out of work, I was able to collect

If you get severance in one lump sum, which Sears/ Kmart don't do, as soon as you deposit that check you are free to collect unemployed. Eddie makes it so former associates can't collect ue.

@pju- this. the wording in your severance package makes it seem like you are still employeed by SHC. The do this to stick it to you one last time and to avoid them having to pay unemployment on you for a time when the store closes. Read your severance package carefully and get a lawyer to look it over. Sears Canada employees signed their lives away and got no severance. Unethical-- you bet. Immoral--absolutely. Illegal- unfortunatley-- no. Just remember this company is not about any employee, no matter how long you have been with the company, no matter how much you have give of your blood, sweat and tears. This company is about Eddie and getting the most for the least amount of money and you are just a cog in the wheel and a means to an end.

Sears called my severance pay a "salary extension". I didn't really understand the distinction. When I filed for unemployment, Workforce called to ask why I thought I could claim money from them when I was still employed! I grabbed my paperwork and read a few sentences packed with legal terms that meant nothing to me. Fortunately, the lady from unemployment understood everything & said "Your employer DID ALL THAT to you? Never mind, I got this." And she did, bless her heart. The week after my severance--oops, I mean my extended salary -- ended, my state unemployment benefits started coming through. You know SHC is wacko when a government bureaucracy appears more humane and considerate!

How is severance paid by sears? Is it included in the last paycheck?

In most states you can have both. Severance, in almost all states is just considered a bonus and not a salary.

In California yes. I thought you couldn’t so I waited until my severance was almost out then I filed for unemployment. Big mistake. On the phone with EDD and they told me I should’ve filed the day I was let go. So yes! In CA you can get unemployment at the same time as your severance.

It depends on the state you live in. In New Jersey it is possible.
