It's not 40 days, it's 35 days for quarterly results after the end of the Q4 (end of january) and 60 days for annual results.

they have 40 days to release earnings after the close of the years per SEC regulations. Miss that and the stock drops 30% in an hour. Remember in business communications: give good news quick and bad news slowly

there is no date yet. Until Sears makes an announcement, which they haven't, it's all speculation. The only consistent thing for years has been they release on Thursday mornings.

The OP probably is referring to the post on this board claiming earnings would be announced on Wednesday this week.
