Laid off 1/18 then WS posts hiring for exact same position that was eliminated 1 week ago? Whats the legality of this.

I've personally witnessed the latest round (a couple weeks ago) get rid of guys that know more about the network than anyone else on the floor. These few that were let go were literally the subject matter experts that kept their associated groups working as they as good as they were & will definitely be missed. Sure, most of the laid off in general were probably the result of being the lowest quality/output employees (the lowest hanging fruit gets picked first), but these guys... man! They were definitely let go in order to make the biggest impact on the financials! The problem is that when they take our best techs/workers from us (just b/c they made the most $$) that makes our service levels go down, which increases churn, which further drives down the public interest in the company/brand, which lowers the stock, which causes the executive & board to want to cut more heads. Its a vicious cycle that BAFFLES ME that no one at the top sees this.

TT: Want to know how to fix our plunging stock?

  1. Bring back the F@#$% DIVIDEND. It was clearly the only reason any power-investors (think: the ones that make the stock price move in either direction) ever invested in Windstream. Windstream had one of the best dividends in the entire Exchange and it was never a "growth" company (at least as far as the stock's performance was concerned), but the company was heavily vested because of that beautiful dividend.

  2. Hire MORE techs, not reduce workforce. Sure, this will increase capEx due to overall cost of paying employees, but the return would be better ability to handle the load or day to day operations, which increases our service levels, decreases churn, drives up the public interest, and ultimately increases the stock (think actual positive cash flow).

From past experience, it appears they do replace employees that have been laid off but they get by with it because the positions are reclassified...

You will need someone on the inside to let you know if they actually fill the position​ by hiring a person. You need to talk with an attorney who does employment law, I would avoid a general practice lawyer.

There was a theory that the layoff was an excuse to let go of people that management had been targetting for awhile but as they had no performance issues nothing could be done about it. By the people let go this seems to be the case. And with job listing popping up 1 week after the positions were supposedly eliminated looks even more so that way.

Its a small group less than 30 people id say. There are 2 managers and 1 staff manager that everyone in the group reports to.
