This seems to keep cropping up- there was no WARN violation committed. It only pertains too more than 50 employees laid off- per location. Which did not happen. To think that BN didn’t have a legal team reviewing their moves for months to ensure they were legally compliant is ridiculous. Regardless of the current state of the business, it is a multi million dollar corporation, and they have a legal team to match.
Also cropping up is PTO- you aren’t getting the full PTO paid out. No sick and personal time is laid out, and vacation is handed to you at the beginning of your anniversary date, but only accrued as you work. So if your anniversary was Feb 1, you only accrued maybe 1 day of vacation. That’s what you’ll be paid.
Insurance, your insurance is paid per week, and your insurance, non-COBRA coverage, was only good through your last actual pay period. Which ended this past Friday. Now the only coverage we have left is through COBRA, which nobody can afford.
Severance payout is based on your last 13 weeks average of hours, so if you averaged 24 hours, that’s what your pay will be based on.
Good luck to us all- at least we won’t be the ones packing up the stores...
