Info on WARN vs layoff date

Here is my updated understanding. Again, feel free to correct me if I am wrong.

According to this FAQ

http://www.edd.ca.gov/jobs_and_training/FAQs_WARN.htm

There is a defination of "layoff date": "A worker’s last day of employment is considered the date of that worker’s layoff."

So the Oct. 11th we are talking about is NOT the "layoff date". It is the notice date. On that day, if there is a layoff, impacted empolyees and both state and local representatives will be noticed. Then impacted employees get to be on payroll for other two months, which fulfills the 60 days requirement of WARN act. Then after that two months, Dec. 11th is the layoff date.

So even if there will a massive layoff notice on Oct. 11th, it is normal that it does not show up on WARN report before Oct. 11th. As a reference, notice date of the layoff on March 1st is March 1st in below report.

Let’s not forget about At Will Employment. Employers such as Juniper can terminate you at anytime for any reason.

I was given one day. Not in California...but in US. What a horror show my VP was and is. IT 3!

Severance packages are also arbitrary, ranging from 2 months to 9 months depending on what your VP decides.

There were folks who were told of being laid off in the morning and asked to leave in the afternoon. The is the Junivator way!

looks like both California and Federal require 60 day notice. If the folks you know were in U.S., they probably stay on payroll for another two months and get a severance check even though they don't come to work. Not sure about other countries though.

Juniper never files any report to WARN! Look at the last mass layoff back in April. There were folks that I know who came in to work on a Monday only to be told their last day will be Friday.

I don't know how Juniper gets away with this. Maybe Juniper does not want bad publicity about layoffs.
