Anyone else having issue with severance pay? I was laid off the 3rd week of January. I faxed everything they asked for and I still haven't received anything. I called 88sears and they gave me a case#. Just wondering if I'm he only one having issues :-(
Seems like there needs to be a class action. Lawsuit
Severance pay is only for full time employees. they get a maximum of 8 weeks no matter how many years you have worked. So if you have been full time for 4 years you get four weeks severence, if you have been full time for 8 years you get 8 weeks severance, if you have been full time for 20 years you still only get 8 weeks severance. And if they company goes BK they may pay you nothing. Severance is not a legal requirement for the company to pay. Just look at what happened at Sears Canada-- no severance and the retirement fund seems to be a mess.
A word of advice. Whenever you fax important documents, always keep a copy of the transmission status report that it was received OK on their end. That is your evidence if someone tells you they never got it.
I don't think so. You'd maybe be able to work something out with your manager in an extreme situation like that but technically they aren't really obligated to pay you anything. Keep in mind that something like this may be above what even your manager can do.
Do part-time people get severance pay if you've been there almost 8 years??
Years ago when I got my pension, it only took me two tries to get things going. Around a 90 day turn-a-round from first initial contact to first check.
And that was when things were going relatively positive for the company.

OP here. I finally got my first payment today after calling 88sears several times I think they are really backed up from all of the lay offs they have done.
I've heard the store manager has to sign something as well. If they haven't done something on their end it holds everything up.
look at you state laws concerning layoff benefits and timely payment. You may have an advocate in your state to lean on the
I'm glad I'm not the only one. I was another one that was let go and haven't received a penny in severance. Then again it's like kmart to penny pinch. They want to lay ppl off but won't give their FT employees and those who were laid off their severance

Same here. There were 6 layoffs at my store including myself. None of us have received a penny. I spent hours on the phone with 88SEARS. I faxed my documents 5 times from the store fax and received a confirmation page each time. Every time I was told they had no record of receiving anything from me. I finally called 88SEARS from the store and told them I wasn't leaving the store or getting off the phone until they gave me an email to send my documents to so I could make sure they received them. They kept telling me I would have to call back in 4 hours because that is how long it takes to confirm if they received the documents I had just faxed. I told them I could talk to them for 4 hours why we wait because I didn't have a job right now and had nothing better to do than waste their time until they stopped wasting mine. After about 40 minutes on the phone they finally agreed to give me an email address and open a case. I am hoping that took care of it. I guess I'll see on Feb 20 which would be my next scheduled pay date. They also owe me 1 week of unused vacation which I have not seen a penny of yet either. Sounds to me like they are putting up roadblocks to keep from paying us.
