Saudi Arabia passed a law that forbids all companies" locally owed or not " to lay off or fire any Saudi person without 60days notice to the labor department with 45days of waiting period to an answer to the lay off. plus the company will have to show all their earning for the last 5 years and the current fiscal year and to find alternative jobs for them and to get all names of foreigners who work at the same company for the labor department to dertmine why Saudis losing their jobs to foreigners. Company will have to comply or it will face shutting down.
UAE also terminated 85% of the foreigners who work in their contry to protect their citizens from lay off.
This all happened last two months and no one seems to know about it.
We in the other hand, we lay off our US Citizens and keep Visa workers untouched.
We have a lot of smart, capable Americans to run many positions this is not about racism it's common since. Look what other countries doing to save their citizens.
I hope our President Donald Trump fix this issue.
If they overhauled the foreign visa program Schlumberger wouldn't have any workers left in the USA!
There are several issues that need to be fixed.
1) Loopholes in the current regulation which allow companies to stretch the visa process ad libitum swapping between visa types, for example keeping an employee on L1 (intercompany transfer) for the maximum amount of time, (6 years), then moving to the H1B (another 6 years) and then apply for an immigration visa and enjoy unlimited renewals, which might means, according to the current priority dates, up to another 10 years of limbo before obtaining a green card. This trick is used by corporations to devalue paychecks because the employee has an extremely limited power to negotiate raises and promotions, therefore the overall average salary for the position just goes down.
A decent policy would be something like 3 years use it or lose it. 3 years should be enough time to see if a well qualified individual can perform the job or not. If not, say goodbye and go back to your country of origin, if he or she is a good performer, apply for a green card and cap the maximum wait to 5 years (for example.)
2) Ethics guidelines which won't allow departments to be flooded by a single racial profile according to the country of origin, Indians hiring Indians, Chinese hiring only Chinese and Caucasian having to hire according to a well selected sample to don't be accused of favoritism or racism.
3) Implement strong regulations and watchdogs on foreign contracting companies which are still free to do any kind of malpractice, for example they impound their employees' social security card, they pay their employees at minimum wage levels even if they have master's degrees and charge companies anywhere from $80 to $250 per hour. Again, this devalue the job market because it creates a massive workforce which want to flee such companies for any salary.
4) Start monitoring companies demographics and outsourcing levels upfront and in a transparent way. In the same way you can find on a car and know how much of it is really produced, designed, and supported by US "persons", and how much is done by "others." In that way you should know where it has been designed and by whom, where has been manufactured and by whom, and who is going to offer support during the lifespan of such product.
5) Implement a strong vetting and health care actions for anyone applying for -any- kind of visa which might lead later to a green card, that should include, but not limited to: international students, L1, H1B, artists and athletes coming to the US. It's pretty pointless that someone get the most common vaccines after spending 12 years in the US and can carry any possible disease while this person keeps going back and forth to the country of origin, the same goes for the FBI background check which should be repeated at fixed schedules and not only once at the moment of the GC (green card) application.
6) Implement a stronger CIA vetting in the consular offices before the release of any kind of visa.
7) Remove loopholes which allow immigrants to buy weapons before having a GC, which technically transforms them in residents with the same rights of any American citizen, excluding the right of vote for federal elections. A typical one is to get a hunting license and then use it to obtain other kinds of semi-automatic weapons and even a CCL, which is baloney.
