you act like you're the very first one to think of this clever little tactic to avoid layoffs. As bad as COP is, they are not retarded like you. They've covered their asses so if you're on the list you're gone.

Being on sick leave, even if covered by FMLA, gives you no legal protection from being selected for severance during a mass layoff. I've seen several situations like this over the few years, some of them absolutely awful. In order to sue on the basis of discrimination, you would need very concrete proof that you were selected for layoff specifically because of your illness, injury, or pregnancy. Concrete proof pretty much means a clear recording admitting the reason for the decision and/or a company document that spells it out. Unless you have that (and if you do go for the jugular), you have no chance. Sign the release, get your full severance, and move on the very best you can. Best of luck to you either way.

If you are on the list you are gone. I had a friend on medical leave last year, but was laid off in October while still on med leave. They called my friend at home to give the news. They had their list of cuts made up a long time before the ax comes down. Maybe they have better ethics now......??? Probably not, but good luck anyway!
