A layoff severance agreement will not apply to the class action suit unless language was inserted into the agreement to cover that.

Not if you were layed off and signed severance package release, that release prevents you from ever be able to sue company. They aren't paying you severance to be nice, they are buying you legal rights to sue. Depending on the size of your severance, may or may not be worth it to sign if you want in on this class action lawsuit.

You are automatically a part of the class action lawsuit if your W2 info was sent out to an unauthorized third party. Unless of course, you choose to "opt out" of it.
