If the ISP is overturned and meanwhile a new job has been offered else where, is there possibility to take the ISP pay out and not go back to Intel and join the new job? What should be strategy to benefit from the package? Any advise is appreciated.

I spoke to one of the transition specialist on phone today to enquire about the options i would have if ISP is overturned and i get a new offer else where. It seems more likely isp will convert into vsp where i would have a choice to either go back or move on with taking the package and can be rehired at Intel. So, i guess i will push out my joining date at new place and wait what intel has to offer, although not inclined towards getting back there.
i too received an ISP and moved ahead with the appeal, but i'm suspending it. Word of caution: HR will only look at whether you qualify for ISP (i.e. SSL4? check.) They will not investigate why you received SSL4 in the first place. For that it's an Open Door Investigation, in which case you have to personally talk to 2 levels of managers.
You'll want to stop and think why they would overturn your ISP. Unless there are legal risks, by taking you back they'll need to let another person go, so do you really think they'll go through that trouble unless there's a risk of getting sued? BTW would you really go back even if ISP is overturned? talk about a huge target on your back for the next round.
Set the start date for the new job a few months out. If they appeal goes through, take it and then turn around and ask for the VSP.
Thanks everyone for the suggestions, i will email HR and check the options. I will most likely opt for the new offer and take advantage of ISP package. Intel seems to be a sinking ship anyway. Wish you best of luck guys for your future endeavors.

Take the ISP, and never think about working for Intel.
Take the offer, dont get greedy, trust me pal. Even if your ISP is overturned, you are marked for next tpyear...
I'm sure you can email HR and drop the appeal. If the ISP is overturned and you leave anyway then I'd suspect you get nothing (though I don't know for sure). If that's what you want to do then end the appeal ASAP.
Don't bother waiting for your appeal. Take the offer.
