Bad label to this year ex-intel employeess further hiring in industry

Just to get what's will be the situation to the people looking for opportunities after this layoff with bad labeling by BK/Intel that this layoff is due to under performing employees to fix the business direction!!!

what's the other hiring employers response due to this bad labeling, is employers not looking the resumes from ex-Intel???

Any thinking how this industry wide bad label can be fixed?

Is that okay from Intel side labelling the layoff on underperformance publicly???

A mass layoff like is occurring reflects poorly on Intel and much less so on the people effected. The layoff criteria and the manner in which this happened illustrates just how badly Intel is managed, especially when prospective employers meet you and understand your accomplishments

Many employers ask the question directly: "were you ever involved in litigation". "Do you have any felonies" " did you ever file bankruptcy". I've personally had to answer those questions many times in new hire paperwork.

Eeeeyyyyup.. it is unjustified defamation against successfully rated employees. Anyone can see that and so will the courts. They even said they would treat those affected with dignity. I hope the industry realizes this. This many underachievers from one company? The people that leave Intel were amazing enough to get the job in the first place, and that is saying a lot. The industry is luck these folks are available.

I can speak to #3. pqb is right, in all likelihood the case would settle out of court and would include a gag order for all parties.

@pqb, @hzr was correct. Yes, most companies do basic background checks which include a quick google search (which will find the case). But you're right that only lead plaintiffs will be named.

I can't speak to #3, nor can I speak to how much weight they'd put on the fact that you were in a lawsuit.

HR people suck. They layoff people and then they come to sites where the laid off workers are trying to find jobs and seek help and they try to mislead them. Next thing you know they come live with you to make sure you cant ever find any jobs. Scum bags.

hzr, you sound like HR. Let's break down your claim that a class action lawsuit is risky. assumptions:

1) assumption: lead plaintiff in a class action is public AND all other plaintiffs are public. I am not an attorney but I believe this is false and typically only the lead plaintiff is public. (And why not use someone semi-retired or starting their own company as lead to take the publicity heat?)

2)"any new job doing background checks". While most employers do CRIMINAL background checks, very few look at other details - especially for technical positions.

3) Assumption of recording of the case. In fact most cases are settled out of court and are never recorded. This would likely be the case here - Intel doesn't want negative publicity cases all over the internet in articles. Which brings me back to where I started: you sound like HR.

Being labeled with a VSP i am really discouraged to continue working for this company. I can find job and my interviews are going very well as i have been doing a great job within a very challenging environment. I did deliver my work (with proof of all the results i have obtained) and have never received improvement required rating. Have taken exceed expectations and successfull ratings over the years. However i failed to play the political game to put it in the eyes of everyone and was in my cubical doing the hard work and deliver. I am very sharp in my field thanks to my mentors who let me grow in my field. I really do not care if i have been given a VSP. I am a great engineer and will soon land in the right place who will appreciate talent. However, i agree with the orignal poster that defamation is something that shouldn't have been done especially to people who have never gotten anything less than succesful rating at focal. If that leads to VSP, then label it IR. And we will leave immediately!!!

Anyone considering lawsuit, keep in mind, that too will follow you in all future employment. Any new job doing background checks will see you were involved in lawsuit with previous employer. That is a job buster.

While I am uncertain if this really qualifies as class action, I think it is unfortunate that Intel management continues to use the performance tag for laid off employees. Where business dictates a HC reduction, let's just call it that. Let's admit that we had hired anticipating growth but that did not happen hence we have to let people go.

This approach shifts responsibility for the the layoff from the employees to management strategy. Hence, I doubt intel management would adopt it. BK and MCM need to own up to their decisions.

All talk no action. Get on the phone and call up the law firm that just sent us the check for the last lawsuit. I have a job but will participate in the lawsuit. They will take on stupid Intel on and squeeze the last ounce before they are completely dead.

I agree, the whole label of underperformance. Is basically defamation of a persons character and is unwarranted for individuals seeking employment.

The only person that should be labeled underperformance is the MAN- who publicly put it out there. But anyone who is watching the market closely would know that. The word spreads and with more " encouragement " for individuals to take the VSP and ERP. Intels reputation will be in the sh$thole.

It takes more than one person to go up against this corporation , it's going to take individuals coming together for the wrong doing of the corporation. And it's not about getting the ob back- it's about the emotional distress, defamation on each and everyone's character. The groups targeted due to age discrimination , or gender and race.

I think it's worth the reputation you've built to stand up to the CEO who is paid more than other CEOs within the industry; he should be offered ER- without severance
