how do you appeal?

The paper work implies you have to email appeals2016@intel.com to get some kind of appeals request to return? Anyone know how it works?

HR is usually on Intel's side (and you are ex-Intel now). So I don't think the person would volunteer to help. The person would have to be subpoenaed to testify, and would presumably tell the truth or perjur himself, or conveniently forget the incident entirely (and it's still a case of one person's word vs. another, since nothing is in writing). If you go down this route, remember that Intel will dig up every single email or instance that puts you in a questionable light. Unless you were a superstar employee who was always on time, never made a mistake, and never missed a deadline, it's very hard to win a suit based on verbal discrimination. My brother does this for a living, and he wouldn't take a case like this with one incident of alleged discrimination and one witness. It really has to be systematic and well-documented for a long time.

Witness was HR rep. Do I trust that HR rep would testify against the manager or are they on manager's side?

tnn, if you can get the witness to talk AND he or she is credible, then you have a case. But if it's not in writing, it will be extremely difficult to prove.

It has to be a situation where it is obvious that Intel will get sued and lose. Something like "my manager wrote on my review that I got dinged because I took MLOA," or "my manager told racist jokes about me in front of witnesses," or something completely atrocious like that. I can't imagine those things actually happening, but there are some stupid people out there...

Send in appeal form even though there is not much chance of success and then file with EEOC. If EEOC finds they may have broken a law, there is a chance you will be reinstated and you get to keep all of severance package money.

You really think after all this they will somehow accept you back? Man, wake up and start spending your energy on finding the next best thing. intel is OVER. I was told it has to be a gross mistake to take you back.
