I was on FMLA and "my position was eliminated"

Time to lawyer up? I didn't think they could do this until I was cleared to work. And that won't happen until May at the earliest...

Seeking counsel may be a good idea. In reading the latest SWN SEC filings, at the December 2015 BOD meeting Mueller was granted over 150,000 shares of company stock. Then on January 6, 2016 another SEC filing concerning the retirement of Mueller, wherein he retires as CEO, Board Chairman, etc. The disconcerting part of all of this is that he gets to vest immediately in all of his restricted stock, maintains his stock options and gets his bonus. Plus, two weeks pay for every year, or part thereof, that he was at SWN. What is wrong with this picture? He admitted, on August 3, 2015, that this mess was his fault, yet he dances out being rewarded for self admitted failures. And, hand picks his replacement and gets thanked for the wonderful job he did, and the great job he did as Bill Way's mentor. The 1100 let go had no fault in the Chesapeake debacle, yet they are not treated as fairly as a CEO who gets to retire with accolades, and a lot of perks!!

I heard there are a couple lawsuits coming over all this so you should definitely check into it. SWN hasn't thought one thing through, do you think they really thought about this layoff down to the fine details! Lawyer up now !!!

If an employee is laid off during the period of FMLA leave, the employer must be able to show that the employee would not have been employed at the time of reinstatement. An employer may also deny restoration to a “key” employee under certain circumstances..... Pretty sure they did their homework before they let you go. Pretty sure they cannot afford any frivolous lawsuits right now.
