How many impacted by ISP are (1) over 40 (2) took sabbatical or (3) MLOA or (4) had personal issues (divorce etc.) within the last 2 years?

I was given 4 ssl 4 four yrs in a row without any performance warning. I was made a default receiver of ssl 4 since I gave not-so-positive but honest feedback about my manager. I regret I did not know the meaning of ssl and trusted my manager too much who is easy-going and yet really deceiving and unethical.

White/Age 57/15yrs @ Intel and received a SSL4 in 2013 and SSL5 in 2015 with Successful performance reviews on both occasions. Made a mistake of working for a Pakastani manager who received 3 consecutive terrible MFT (Manager Feedback) scores and he blamed me and told me that to my face. I stayed one year to long in that group. He was demoted to IC and re-assigned.

I will be seeking legal counsel. Can anyone can recommend a good employment law firm in AZ?

Anonymous115215, have you talked to any lawyer about class action lawsuit? this ISP is framed as "performance" termination. Intel has the data to show that some employees have been receiving SSL4/5 several times in the past 2-3 years.

2 medical LOAs in the last two years... ==>2 SSL4 in the same two years, both explained as "well, you didn't have as many accomplishments as your peers". You think? Last payletter didn't even have a focal document, and manager admitted he was too new to the group to know what accomplishments happened. rensponse from HR Legal -- yeah, it's fishy, but nothing can be done about it. Nice, huh?

Age 59, white, personal issues aplenty - we were doing in-home eldercare for a parent, had a death in family, and more.

I also noticed that the "Separation and Release Agreement" was sent as a PDF file named "US_40+_Release.pdf".

I also got the Intel_Disclosure_Document.pdf which contained ages of the affected and not affected people and computed that 80% of the affected people were over 40.

White male, Age 44, 19 years at Intel, death in family caused mom to move in with us but I was up for promo in '13. No promo - 100% positive review. Received slightly higher raise but lower stock. Passed up for promos, trainings, and travel during last 4-5 years. Major disconnect with manager (who accepted an IC position in Q1) causes S5 this year, despite solid accomplishments and many awards. Chose to focus on 2015 rather than fight it. Was covering a +2 grade sabbatical in order to prove I deserved promos years ago as well as open up new opportunities when I received ISP. Received another DRA the following day, but email was the only acknowledgement. Previous manager cancelled 1:1s and only spoke with me 5 mins prior to an open door escalation. New group was willing to use a req on me but it appears no exceptions are being made.

Thought I opted out of the antitrust suit as I feared an employment impact, but it appears I never sent in the request. This is an AR I don't regret dropping!

Prepare for the worst when you are back from ML, Anonymous113669. A lot of employees who got affected by this has little or nothing to do with their performance. Unfortunately, they are being labelled as "repeat low performer". Stay well and update your resume. Hope u get well soon

Maybe a potential lawsuit but you won't have the money to hire a good law firm to fight. Get better and move on!

Anonymous113720 If what you said is true. This means your Indian manager is preparing to give your a bad review. Usually in a team with Indian manager Indian co-works have a higher priority to get promoted or recognized. If he have to put someone in bad ranking it usually a non- Indian. So talked to HR and talked to your boss's boss immediately before it is too late. If he later gives you a bad focal it will be too late for you to make a complain to HR. So raise this issue and speak out. You basically have no other choices.

I am the only non-Indian in my group and am senior level engr. My Indian manager recently hired 3 Indian RCGs without asking me to interview any of them. I have been informed by my manager that my focal reviews will be dependent on the success of these RCGs. Should I be concerned?

It is not H1B is cheaper. It is because intel managers original from India only like to hire their own India people. So that they can build a network systematically across the company with their own people. I heard of many cases that candidates from other nationalities are discriminated and turn down by India managers. This has to be stopped. It is very unfair to other engineers from other ethnics. It also weeken intel's competitiveness . We already see some signs that intel is not able to do a good job technically such as mobile computing.

I agree that H1B visa engrs are not underpaid and probably costs more for Intel to hire. That makes the ethnic favoritism (Indian) even worse, especially with recent college grads. Managers cannot say there is a lack of qualified applicants when job openings are essentially entry level.

I want to debunk a myth here. Engineers hired on H1B Visa are not underpaid. At least not at large corporations like Intel. Based on offers I've seen, the pay for US citizens and non-citizens are the same. In fact, my guess is it cost Intel more to hire foreign workers because of the lawyer and application cost associated with visa and green card. Groups I've worked in encourage giving priority to hiring US citizens and sometimes completely restrict hiring of foreign nationals. It is much easier for a US citizen to be hired than a non-citizen. However, the advantage US citizens have can only take us so far. I can't expect to have a 3.0 GPA and beat out a non-citizen with 4.0 GPA.

I am not in my 40's; technical female; Indian and on the H1B. I am that one person who intel can use to not get sued I suppose. I been less than 5 years here.The only mistake was switched to a new position with a completely new functional area and fell into this scenario. Took it to HR, the HR almost agreed that my manager should have given a mid year review but said 'sorry I can't do anything'. Even though HR agreed to all my claims but in the end said 'sorry'.

Apparently some Intel departments unaffected by layoffs this time around. I and many on my team definitely would have part of this Successful SSL4/5-You're Fired club. The paranoia is now intense for Intel employees.

45, took sabbatical. Boss not able to find coverage for my work in spite of my months of prep/training of others. Boss dinged me with SSL4 and blamed me for project delay. Reported issue to HR. Not currently part of layoff because of coming forward.

46, no sabbatical or MLOA, but my family has been dealing with health issues so I'd been working from home more than usual. Still, my manager and his manager were both happy with my performance, and the SSL4s were never considered to be a negative performance message.

I would've celebrated my 20-year anniversary with Intel next month, and would've been eligible to retire in 6 years.
