Question for "employment lawyer"

I complained in writing about my bullying manager, and HR covered it up. Is it worth mentioning this if I'm told to GTFO?

If you are told to GTFO, there's not really much room for negotiation. IF you don't go, you're technically trespassing. Hopefully you kept a copy of your written complaint. The law is relatively new w/r/t workplace bullying. (See link.) Not too many cases out there. If you could prove that your termination was related to the bullying issue or a direct result of your complaint to HR, you may have a case. Send your HR Mgr. a written request for your full employment file. Talk to an attorney about filing a complaint as soon as possible with DFEH. (You can file the complaint on your own, but attorneys may help you word it better, and may also point out other potential causes of action that you will need to include.) To preserve all federal and state claims, you must do this within 180 days of the most recent occurrence of workplace harassment.

My manager forced me to stop work on a patent for idea that was later disclosed by academia. I was understandably upset and voiced my frustration. For this, my manager threatened me with pip. I told my VP that this manager would not be writing my next review. I told my VP that if this manager was writing my next review, I would not be around to hear the results. That manager (a total kiss-ass) was moved to another department. I should have left the company when this happened, and that was way back in 2004 ...

If you complain from your manager to HR, your manager can retaliate against you and PIP you out on phony reasons with unconditional support from HR. Remember that HR are a group of semi-literate puppets. They don't have any brains, independence, or will to uphold any value or company culture. So get ready to be PIPed out. What you can do now is to document your accomplishments and everything that you have written or happened. It will help you negotiate your package.
