Come on. You'd probably be better off looking for a better paying job. That would have a positive net effect of your net worth. The latter is a waste of time. At the end of the day the only thing that matters is what's in your wallet

109064: 109128 is right. If an older employee is PIP'ed then terminated based on prior performance reviews and the highly subjective scoring used for PIPs, neither federal nor state courts will challenge the underlying performance reviews, or PIPs. Even if the employee is over age 40. The exception is if you can PROVE that the employer overtly discriminated against older employees, OR if you have documented evidence that the manager/supervisor, etc. manufactured pretextual evidence or otherwise violated company policy or laws. This is difficult to come up with. I know of only one employee who might be able to prove it.

I am being real. I've worked at many companies before, and especially at a tech company you'll never had the positive proof to make claims of age discrimination. You're better off making claims of sexual harassment or racial discrimination or by being a whisteblower for some unlawful/illegal activity a business is engaging in (such as bribery,kickbacks,etc). It's wishful thinking that a lawyer will ever entertain your unproven claims of age discrimination. From an attorney's perspective, very difficult to prove, and most won't be willing to take a case on unless you're going to pay for the attorney's fee up front (because they know your chances of winning are low, so they want to be paid by you). That's why you haven't seen many cases at all at any of these companies locally. Wishful thinking trying to "sue" a company over something unproven...You know I'm right, because if I wasn't and if you were correct, you wouldn't be blogging about what you think should happen. You would already be talking to an attorney and seeking class action status. But you aren't, are you? Thought so. Just quit, find a better position. If you're worth your salt in terms of skill, you should be able to find something.

I seriously have to wonder if some of you posters really work at the Q or are just bitter from somewhere else. The (il)logic some of you are demonstrating contradicts the above average stringent interview requirements of the Q, so I would be surprised if you passed getting hired in the first place. Some of you folks sound so illogical, I have a hard time believing you would have the mental capacity to be even an engineer.

109047 Get real! Qualcomm Executive Management is discriminating by targeting Senior Employees and creating Phony PIP's to keep the number of terminated employees under the radar. If they want to get rid of an employee they simply give them undeserved bad Performance Reviews. There is a meeting of the minds among several Managers and then you are doomed. This is happening frequently at QC. A sharp Attorney is likely to discover this and file a class action lawsuit. Stay tuned!

My god, some of you guys need to work on that remedial english. I mean, I don't mean you need to have have every word spelled correctly or best grammatically correct sentence. But in a lot of the writing, I can barely understand you. It's unlikely you are from overseas, because while most overseas people might have an accent when it comes to spoken english, they usually have a pretty good command on written english. Often times, it's better than what us domestics write.

But anyway, as long as you are an employee of a company, you do need to take whatever shit they dish out, as long as they aren't breaking any laws, or if they are, as long as they can do it without any proof. Your gripe with management, as shitty as they maybe be performing, is hardly illegal or unlawful. Unless you have proof of something unlawful (which then, changes the game, since you can seek protection under the whistleblower provisions in our country's laws), you have to put up with any shit they dish out, unless you quit and go somewhere else.

@109011: Yes, you can always find another job if you don’t like it. That does not mean you take crap when it is dished to you. We are Americans and we don’t take crap from no one, and that includes another American. There are laws that bound the conduct of management, and then there are reasonable expectations of ethical and professional conducts. QC managers think they have license to abuse, but they really don’t realize their conduct may be illegal, or at least unethical, if someone chooses to challenge them. The problem is that on one challenges them.
