HR has to tell you to not sign your separation agreement right away, to seek advise, etc. When you ask your legal counsel to take a look at it you will be $100 poorer when they confirm that it's a good package. Your pain in having been suddenly and mostly unexpectedly told that your position has been eliminated and today is your last day at Target may drive the desire to expect more. Give it some time and before the final date your paperwork is due, sign and post mark it in time to meet the requirements. A generous severance package like this is remarkable in this economical climate.

No need to contact me. I can tell you quite emphatically that there isn't any conceivable scenario where you would fare better by forgoing this extremely generous severance package and risk not getting anything. This would never make it to trial anyway. We'd end up settling and I would get 30% plus fees of any settlement that was reached. Calculate how much we'd actually have to settle on to exceed what you've already been offered. I'm begging you, all of you. Sign the documents and move on with your lives. Packages this generous are exceptionally rare. Take it. For the love of God, take it.

One more thing OP, and I'm sure I'm leaving several other perks and benefits out. You are also entitled access to Targets employee health plan for 6 months rather than COBRA. That extremely generous benefit is something Target is also under no obligation. To provide to you. As your counsel, my professional advice to you would be to sign that severance agreement before they change their mind.

In will do so pro bono, right here right now. Your severance package has you on the parole until May 9th, even though you don't actually have to work through that date. This satisfies the 60 day notification requirement under the warn act. You were most likely provided a list of impacted ages, positions, pay grades etc that clearly indicates there was not any party flow group at was over or under represented. Finally you were given an additional six weeks of pay, the entirety of your remaining paid leave balance, plus one week pay for each year of service; none of which Target is obligated to provide to you.

Are you in a union? If not sign and walk away. You are lucky what you are getting. Target can give you nothing if they want.
