Thread regarding Target Corp. layoffs

Is anyone not signing the severance paperwork and thinking of a class action suit?

There were teams in which some were let go and some were kept. Isn't that discrimination? What was the reason to let some go and not others? It was clearly not performance based? Did everyone sign the paperwork and mail it in or are some people thinking of getting more $ by consulting a lawyer? Also are we simultaneously allowed to file for and get unemployment in this state?

I would direct any questions about your Unemployment eligibility to the Umployment Office. But typically you need to wait until your "last day of employment" to file.

To the person about unemployment. When your severance date ends you can go on unemployment if you havent yet found a job

Oh PLEASE. Discrimination? I was one of those laid off. If any case could be made it is that they hit the older people (myself included in that august bunch) as they do in most layoffs. Guess why? Because we earn (cost them) more, will eventually cost them more in health care, and will leave "soon" anyway, etc, etc. And as everyone in the workforce (not just Target) is dispensable, there will always be some young turk they can bring in to take your place. It may take a little training and time, but so what? Target sells T shirts and toilet paper. The stuff we do (did) isn't rocket science or that critical to society. No one dies if the right stretchy thing isn't on the shelves. It was a nice gig while it lasted and the severance is way beyond what's typical in the "real" world (which in my profession is a thank you and a hardy handshake). In reality Target doesn't owe you diddly squat - you are an employee at will. That's how it works - you work they pay you. End of story. Do I wish I could have stayed on for another 2 years, sure. Like another poster said, unless the choice was made by race or gender, you don't have a case. Maybe you were laid off to balance the numbers of us oldsters, but that's life. Life and the law don't promise it will be fair. "Some teams were let go and others weren't"....uh yeah, duh. That's what businesses do when they reorg for a new direction (which god knows target needs to do). So take the man's nice package and move on with your life.

Take the package and run. You will not gain anything by fighting this. If you were to get anything, attorney fees would eat that up. You'd walk away sacking your thumb.

PLEASE don't sign. We can sue Target and if needed, take your case to the Supreme Court! Trust me, you will be a hero and everyone will know your name.

Please. How freely you throw around the word "discrimination." Ignorant people like you give people who have legitimate descrimination cases a bad rap. With your attitude, you'll never be happy. I'd advise you to stop victimizing yourself, take your surprisingly generous severance, and move on with your life. Stop trying to turn this into something it's not and grow up. YOU are the reason Target HR is overstaffed. Too many sniveling, victim baby-types who are technically adults but act like children. WAKE UP TARGET TEAM MEMBERS! You are now entering the real world!

Thanks all. Just wanted to know whether I wasn't the only fool to sign it day 1 and mail it in! But it appears I am on the right path! Thank you all for your inputs. This site is fantastic!

BTW, I heard in some states (California) you can get unemployment despite getting a severance!

I have spoken to an attorney. He stated that the way Target appears to have handled this, it would be pretty difficult to make a case for discrimination. All indications are that they based this on salary and longevity. If we could prove that they made the selections based on the color of skin or everyone was in the same age bracket, then that could be a different story, but I think Target went into this covering their backsides pretty well.

I think it is best to move on. In my opinion, Target has pretty much done us a favor. It has become a horrible place to work, being more and more dysfunctional by the day. I believe down the road, history will show that those of us in the early round of layoffs are the lucky ones. Packages could be less attractive down the road, and there will be more and more of us out there looking and saturating the market. I predict that a very high percentage of us will find something WAY BETTER in fairly short order.

My suggestion for you is to move on. Not signing will only draw it out and there is no guarantee you will have a valid claim. Most of what you receive would end up in attorney fees. My suggestion is to sign, file for UI and move on.

When your severance equivalent weeks run out you can file for unemployment. You file and add that info in and it will tell you the date.

Not performance based, but based on salary. That is not discrimination. Let it go already.
