Can layoffs be based on RTO non-compliance? Yes, of course, or:
You have BO
You are cross eyed
You once missed a meeting in 2019
Your Manager is friends with your co-worker
You once said the sky is blue
Any reason they want as long as they can claim it is not because you are in a protected class. Heart at Work my friend, HEART AT WORK!!

They would be foolish not to get rid of those non-compliant because, as others have pointed out, they can do so without offering severance because they will be firing you for not complying with a direct order, not laying you off for business reasons not under your control.

ROTC is not the migrating factor. It may be one of many factors. Higher wage, take the two employees who have the same duties and performance and layoff the higher waged employee. To automation, to political basis, to team players vs non team players.
There are Executives and Directors who have been shielding their precocious wah and post civil wah because that's just how fubar ROTC for the majority of the organization.
