Has anyone seen any WARN Notices?

If there are upcoming RIFs starting as soon as tomorrow, wouldn’t Elv had to of filed WARN notices? Especially given the magnitude of a 10-20% reduction, I would think they would have had to file something ahead of time. I tried looking to see if any have been filled and have not seen anything. Curious if anyone else has?

The Warm Act is Federal and applies to all states as well as American territories. States can make the rules more stringent but not more lax.

only saw one from last year for the Woodlandhill, CA location. I am thinking they can give you a 2 months notice and then submit the Warn

Can my employer provide a severance package instead of notice?

It is possible for an employer to provide a severance package instead of notice in two situations. First, the severance package may be conditioned on waiving any claims under WARN. The conditions for waiver are discussed in the next question. Secondly, the severance package may offset WARN, this effectively providing pay in lieu of notice. There are certain circumstances under which WARN allows "voluntary and unconditional" payments that are not required by a legal obligation or collective bargaining agreement to be offset against an employer's back pay obligation. However, payments that are required by a contract, such as an employer's personnel policies (or much less likely, state law), would not offset WARN damages and, thus, would not serve to reduce the employer's liability.

You 100% will NOT see WARN....trust me i have been through these many times in multiple organizations. Companies do what they are required to do to avoid a WARN.

@OP+1tTChcFf - warn notices . Trust me they know what they're doing. They spread it thinly enough among locations to keep the numbers low enough to avoid rif-raff.
