As long as you pay during the WARN notice period you don’t have to allow them to keep working.
UKG may have skirted WARN regulations by using the "Garden Leave", but the way they conducted this layoff was extremely shady and either does not appear to follow WARN regulations, or is a clever way of avoiding backlash. This companie's business practices should be investigated by the FTC and other agencies.
@pix+1tEwh5lN, they put the employees on 'leave' for a long enough period to fulfill the WARN requirements. Their termination dates are after the leave period. Employees are receiving compensation during the leave. This is not the severance, that is separate.
This is a WARN act violation. For anyone who reviews this post, it appears UKG failed to properly file warn notices throughout the country. This is an egregious mistake, and there will be consequences. States like California require a 60-day notice, whereas New York is 90 days. So, even though UKG may have come back and filed the WARN notice after the fact, they are out of compliance since the effective termination of employment has already occurred. Because of this, those employees are entitled to compensatory wages for the period in which the WARN act is still pending and their employment has already been affected, regardless of whatever may be provided as severance. Employees in their respective states should file WARN act violation notices with their respective employment division and allow that state to contact the former employer regarding the violation.

The employees were notified on July 3 that they were being placed on 'garden leave' through Sept 9 at which time their separation would take effect.

Throwing out there that the mass layoff occurred July 3rd. September 9th puts them just over the 60 day reporting threshold. I'd wager that this WARN is related to the layoffs.
